These Terms & Conditions govern your use of https://www.beforethebuild.net, the Before The Build sales office software, and text messages from Before The Build. Before The Build is operated by Big Mammoth Media. By using the site or service, or by opting in to texts, you agree to these terms.

The service

Before The Build is a sales office tool for home builders. It fills the builder’s own templates with information the builder’s team enters and produces documents such as reservation agreements, quotes, contracts, and selection sheets, and it helps builders text, schedule, and collect signatures and deposits from their buyers.

Not legal advice

Before The Build does not provide legal advice, and nothing in the service or on this site is legal advice. We do not write, review, or approve contract language. Each builder’s attorney owns that builder’s templates and is responsible for their content.

Accounts and acceptable use

Builders are responsible for their users, for the accuracy of what they enter, and for getting any consent the law requires before texting their buyers. Don’t use the service to send spam, unlawful content, or messages to people who haven’t agreed to receive them. Builders text their own buyers under their own name and their own texting terms; those messages are the builder’s program, not Before The Build’s.

Billing and payments

Subscriptions are billed monthly or annually as agreed in each builder’s order; monthly plans are month-to-month. Texting is prepaid from each builder’s texting balance. Buyer deposits are paid into the builder’s own Stripe account; Before The Build does not hold buyer funds.

SMS Terms

  • Program name: Before The Build Text Messages, sent by Before The Build (Big Mammoth Media).
  • Program description: we text people who ask us to, for example by checking the texting box on our contact form. Messages include replies to your inquiry, demo scheduling, appointment reminders, and account and support notices.
  • Message frequency varies depending on your conversations with us.
  • Message and data rates may apply. Check your mobile plan for details.
  • To opt out, reply STOP (or CANCEL, END, QUIT, or UNSUBSCRIBE) to any message. We’ll send one message confirming you’re unsubscribed, and you won’t get more texts unless you opt in again by replying START.
  • For help, reply HELP to any message, email ian@bigmammothmedia.com, or call (918) 340-2341.
  • Consent to receive texts is not a condition of any purchase.
  • Carriers are not liable for delayed or undelivered messages.
  • Privacy: your mobile number and opt-in data are handled as described in our Privacy Policy. We do not sell or share your SMS opt-in data or personal information with third parties or affiliates for marketing purposes.

Disclaimers and limitation of liability

The service is provided “as is.” To the fullest extent the law allows, Big Mammoth Media is not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Changes and governing law

We may update these terms and will post changes on this page with a new date. These terms are governed by the laws of the State of Oklahoma.
